San Diego has one of the tightest rental markets in the state, and an eviction notice here can feel like the end of the road. It usually isn't. Getting eviction help in San Diego early lets you use protections that many renters don't know about, including a city ordinance that goes further than state law. This page covers where San Diego eviction cases are heard, which rules apply, and how to get your papers reviewed remotely.

Eviction Defender is not a law firm. We provide tenant guidance and document preparation, and your first case review is free.

Where San Diego County eviction cases are filed and heard

San Diego is different from most counties: all eviction cases countywide are centralized downtown. The Superior Court of California, County of San Diego requires unlawful detainer cases to be filed in its Central Division at the Hall of Justice, 330 West Broadway, where the civil business office handles filings. The cases are heard in the Central Division too, in the downtown Central Courthouse.

That means a tenant in Oceanside, Escondido or Chula Vista files in the same place as a tenant in North Park. The eviction courtroom moved within the Central Courthouse in late 2025, so always check the department and address printed on your Summons (SUM-130) and any hearing notice.

San Diego's Tenant Protection Ordinance

If you rent within City of San Diego limits, the Residential Tenant Protection Ordinance, in effect since June 24, 2023, gives you more than the state's Tenant Protection Act (AB 1482):

  • Just cause from the start. Unlike state law, which usually kicks in after 12 months, the city ordinance generally applies to covered tenancies without that waiting period (very short leases and some other categories are excluded).
  • Bigger relocation help. For a no-fault eviction, the landlord generally owes two months' rent, or three months' rent if a tenant is 62 or older or disabled. It can be paid directly or waived from final rent.
  • Right to return. If a unit is re-rented within five years after a no-fault eviction, the landlord must offer it to the displaced tenant.

Outside city limits, other rules may apply. Chula Vista has its own tenant protection ordinance, and Lemon Grove passed temporary extra protections for no-fault evictions in early 2026. In unincorporated areas and most other cities, AB 1482 is the main protection. We check your exact address during your free review.

Common San Diego eviction situations

  • 3-day notice to pay rent or quit. Weekends and court holidays don't count toward the three days. Learn what a valid notice must include in our guide to the 3-day notice to pay rent or quit.
  • No-fault notices for "substantial remodel" or owner move-in. In the City of San Diego, these carry the larger relocation payment, and the notice has to meet the ordinance's requirements.
  • Short-term rental conversions and sales near the coast and in tourist areas, where the reason given needs to match a real just cause.
  • Military households near bases who receive notices around a move or deployment.

Once you're served with an eviction lawsuit, you generally have 10 court days after personal service to file a written Answer (form UD-105). Missing that deadline lets the landlord ask for a default judgment. See how to respond to an unlawful detainer in California for the steps.

When You Choose Our Services, It Matters More Than You May Know

There was a time when my family and I faced eviction.

We did not have the resources, information, or understanding we needed at the time. We were confused, anxious, and worried about how I was going to take care of my family. I felt powerless standing against a landlord and their attorney because I simply did not know what I needed to know.

That experience stayed with me.

Later in life, I was blessed with the opportunity to come full circle—to learn, research, understand, and obtain the information I once desperately needed. What I went through became more than just a difficult chapter in my life. It became a purpose.

Today, when someone comes to us facing an eviction, foreclosure, landlord-tenant dispute, or another serious matter, I don’t look at their paperwork as just another file.

I understand that there is a person and a family behind those papers.

When I hold your paperwork in my hands, I remind myself that you are trusting me with something incredibly important. In a very real sense, I am holding a representation of your life in my hands.

That responsibility matters to me.

Our clients have shared their experiences through Yelp and Google reviews, telling us that our services helped them when they were facing difficult and uncertain circumstances. While every situation is different and no outcome can ever be guaranteed, those words mean a great deal to us because they remind us why we do what we do.

You deserve information.
You deserve to understand your situation.
You deserve to know what options may be available to you.
And you deserve to be treated with dignity and compassion.

When you choose our services, you’re not just choosing someone to look at paperwork.

You’re choosing someone who understands what it feels like to be on the other side of that paperwork.

Because I’ve been there. And that’s why your situation matters to me.
