Eviction Help in Oakland and Alameda County, California

Oakland has some of the strongest tenant protections in California, and many eviction notices served here don't follow all of the local rules. If you're holding a notice or court papers, getting eviction help in Oakland quickly can make a real difference. This page explains where Alameda County eviction cases are heard, how Oakland's Just Cause for Eviction Ordinance works, and how to get your paperwork reviewed remotely.

Where Alameda County eviction cases are heard: Hayward, not downtown Oakland
This surprises many Oakland renters. Evictions (unlawful detainer cases) are filed in the Superior Court of California, County of Alameda, and the court assigns them to a dedicated department at the Hayward Hall of Justice, 24405 Amador Street, Hayward. So even if you live in West Oakland or Fruitvale, your eviction hearing will usually be in Hayward, not at the René C. Davidson Courthouse at 1225 Fallon Street in Oakland.
A few practical points:
- The Hayward clerk's office offers appointments for filing unlawful detainer and landlord-tenant documents, so you don't have to wait in line.
- Hayward also has a drop box for civil filings.
- If you've lost the case and need more time to move, an application for a stay of eviction can be filed at a courthouse that accepts civil filings, including Hayward or René C. Davidson in Oakland.
Always confirm the department and hearing date on your Summons (SUM-130) and any court notice.

Oakland's Just Cause for Eviction Ordinance and Rent Adjustment Program
Oakland's local law goes well beyond the state's Tenant Protection Act (AB 1482). Under the city's Just Cause for Eviction Ordinance:
- A listed just cause is required. A notice to terminate a covered tenancy must state one of the specific just causes listed in the ordinance.
- Notices must say where to get advice. Every eviction notice must include the grounds and a statement that advice is available from the city's Rent Adjustment Program (RAP).
- Notices must be filed with RAP. The owner must file a copy of the eviction notice with RAP within 10 days of serving it. Failing to do so is a defense to the eviction case.
- Rent registration counts. For covered units, failing to register the unit with the city can be a defense in most eviction cases, including nonpayment cases.
Oakland's rules have been amended several times by voters and the City Council, and which ones apply depends on your building. Berkeley and the City of Alameda run their own rent programs with separate rules. Elsewhere in the county, AB 1482 usually applies.

Typical eviction notices and cases in Oakland
- 3-day notice to pay rent or quit. Weekends and court holidays don't count toward the three days. In Oakland, also check whether the notice includes the RAP statement and whether it was filed with RAP. See our guide to the 3-day notice to pay rent or quit.
- Owner or relative move-in notices, which come with strict local conditions and relocation payments.
- Notices in small buildings and ADUs, where whether Oakland's ordinance applies can be a close question.
- Nuisance or lease-violation notices. See our guide to the 3-day notice to quit for nuisance.
Once you've been personally served with a Summons and Complaint, you generally have 10 court days to file a written Answer (form UD-105). Oakland's local defenses, like an unfiled RAP notice, generally need to be raised in your Answer, so don't wait.

When You Choose Our Services, It Matters More Than You May Know
There was a time when my family and I faced eviction.
We did not have the resources, information, or understanding we needed at the time. We were confused, anxious, and worried about how I was going to take care of my family. I felt powerless standing against a landlord and their attorney because I simply did not know what I needed to know.
That experience stayed with me.
Later in life, I was blessed with the opportunity to come full circle—to learn, research, understand, and obtain the information I once desperately needed. What I went through became more than just a difficult chapter in my life. It became a purpose.
Today, when someone comes to us facing an eviction, foreclosure, landlord-tenant dispute, or another serious matter, I don’t look at their paperwork as just another file.
I understand that there is a person and a family behind those papers.
When I hold your paperwork in my hands, I remind myself that you are trusting me with something incredibly important. In a very real sense, I am holding a representation of your life in my hands.
That responsibility matters to me.
Our clients have shared their experiences through Yelp and Google reviews, telling us that our services helped them when they were facing difficult and uncertain circumstances. While every situation is different and no outcome can ever be guaranteed, those words mean a great deal to us because they remind us why we do what we do.
You deserve information.
You deserve to understand your situation.
You deserve to know what options may be available to you.
And you deserve to be treated with dignity and compassion.
When you choose our services, you’re not just choosing someone to look at paperwork.
You’re choosing someone who understands what it feels like to be on the other side of that paperwork.
Because I’ve been there. And that’s why your situation matters to me.
