Orange County homes carry some of the highest values in the state, which means a foreclosure here can put a lot of equity at risk. If you've received a notice, you can often stop foreclosure in Orange County, or at least keep control of how the story ends, by understanding the timeline and acting on it. This page focuses on what's specific to OC, including homeowners association (HOA) foreclosures, which are common in the county's planned communities.

Where Orange County Foreclosure Notices Are Recorded

Foreclosure documents are recorded with the Orange County Clerk-Recorder, based in Santa Ana. The first one is typically the Notice of Default, recorded after you've fallen behind. Under federal rules, a mortgage servicer generally can't make its first foreclosure filing until the loan is more than 120 days delinquent.

At least three months after the NOD, the trustee may record a Notice of Trustee Sale, which must be given at least 20 days before the sale.

Where Orange County Trustee Sales Happen

Many Orange County notices set the auction at the north front entrance to the county courthouse, 700 Civic Center Drive West in Santa Ana. Other notices have used a hotel meeting room in the Anaheim/Orange area. Because the trustee decides, the only location you should rely on is the one printed in your notice. Sales are often postponed, so confirm the date with the trustee before you plan around it.

HOA foreclosures in OC

Your HOA can also foreclose for unpaid assessments, but California limits this. An association generally can't foreclose unless the delinquent assessments are at least $1,800 or more than 12 months overdue, and a nonjudicial HOA foreclosure sale is subject to a right of redemption afterward. If your HOA is threatening foreclosure, ask for a payment plan in writing right away.

How to Stop Foreclosure in Orange County, Before and After a Sale

After the Notice of Default

Ask your servicer for a loan modification, forbearance or repayment plan, and send a complete application. California's Homeowner Bill of Rights generally keeps a servicer from moving toward a sale while a complete application is pending, with conditions. You can also reinstate by paying the past-due amount and fees.

When the sale is scheduled

You can reinstate until five business days before the sale, and you can pay off the loan in full any time before the auction. With OC home values, selling before the sale is often the best way to keep your equity. Our explainer on reinstatement vs. redemption breaks down the math.

After a trustee sale

A mortgage trustee sale is final: there's no right of redemption afterward. Look into cash for keys if the buyer wants you out quickly, and check whether the sale produced surplus funds, which the trustee holds for the former owner and junior lienholders. You don't need to pay a finder to claim them. If you're served with eviction papers, see our Orange County eviction help page.

When You Choose Our Services, It Matters More Than You May Know

There was a time when my family and I faced eviction.

We did not have the resources, information, or understanding we needed at the time. We were confused, anxious, and worried about how I was going to take care of my family. I felt powerless standing against a landlord and their attorney because I simply did not know what I needed to know.

That experience stayed with me.

Later in life, I was blessed with the opportunity to come full circle—to learn, research, understand, and obtain the information I once desperately needed. What I went through became more than just a difficult chapter in my life. It became a purpose.

Today, when someone comes to us facing an eviction, foreclosure, landlord-tenant dispute, or another serious matter, I don’t look at their paperwork as just another file.

I understand that there is a person and a family behind those papers.

When I hold your paperwork in my hands, I remind myself that you are trusting me with something incredibly important. In a very real sense, I am holding a representation of your life in my hands.

That responsibility matters to me.

Our clients have shared their experiences through Yelp and Google reviews, telling us that our services helped them when they were facing difficult and uncertain circumstances. While every situation is different and no outcome can ever be guaranteed, those words mean a great deal to us because they remind us why we do what we do.

You deserve information.
You deserve to understand your situation.
You deserve to know what options may be available to you.
And you deserve to be treated with dignity and compassion.

When you choose our services, you’re not just choosing someone to look at paperwork.

You’re choosing someone who understands what it feels like to be on the other side of that paperwork.

Because I’ve been there. And that’s why your situation matters to me.
