How Foreclosure Starts in Los Angeles County

Most LA homes are foreclosed without a lawsuit, through a "nonjudicial" trustee sale. Under federal rules, a servicer generally can't make the first foreclosure filing until your loan is more than 120 days behind. After that, the trustee records a Notice of Default (NOD) with the Los Angeles County Registrar-Recorder/County Clerk, whose headquarters is at 12400 Imperial Highway in Norwalk.

LA County has a local safeguard many owners don't know about. Through its Homeowner Notification Program, the Registrar-Recorder mails owners a copy of certain documents recorded against their property, including a Notice of Default or Notice of Sale. If you got one of these mailings, it is not junk mail. Read our guide to the Notice of Default in California to see what each line means.

Where Los Angeles Trustee Sales Take Place

A Notice of Trustee Sale can't be recorded until at least three months after the NOD, and it must be given at least 20 days before the sale. The notice names the exact date, time and place. In LA County, many published notices have set auctions at the Civic Center Plaza at 400 Civic Center Plaza in Pomona, and others at a Norwalk hotel near the county offices. Locations vary by trustee and can change, so always go by the address printed in your own notice, and confirm the date with the trustee because sales are often postponed.

How to Stop Foreclosure in Los Angeles at Each Stage

After the Notice of Default

This is the stage with the most room to work. You can apply for a loan modification, forbearance or repayment plan. California's Homeowner Bill of Rights limits "dual tracking": once your servicer has a complete modification application, it generally can't move ahead with a sale while that application is pending, subject to conditions. You can also reinstate by paying the past-due amount plus fees, up to five business days before the sale.

When a sale date is set

Time is short, but options remain. You can still reinstate until five business days before the sale, or pay off the full loan (redemption) any time before the sale. Some owners with equity sell quickly to protect it. Our article on how to stop a trustee sale in California walks through each route.

After the sale

In a nonjudicial sale there is no right to buy the home back afterward. Two things still matter. First, a new owner may offer cash for keys, money in exchange for moving out by a set date. Second, if the house sold for more than the debts, the trustee holds surplus funds for the former owner and junior lienholders. You don't need to pay a "finder" to claim them. If the new owner files an eviction case, see our Los Angeles eviction help page.

Frequently Asked Questions

Who records the Notice of Default in Los Angeles County?

The trustee records it with the Los Angeles County Registrar-Recorder/County Clerk in Norwalk. Through the county's Homeowner Notification Program, owners are mailed a copy of certain recorded documents, including a Notice of Default or Notice of Sale.

Where will my Los Angeles trustee sale be held?

The exact place is printed in your Notice of Trustee Sale. Many LA County notices have named the Civic Center Plaza in Pomona or a location in Norwalk, but trustees choose the site, so rely on your notice and confirm the date with the trustee.

Can I stop foreclosure in Los Angeles once a sale date is set?

Often, yes. You can reinstate the loan by paying the past-due amount and fees up to five business days before the sale, pay off the loan before the sale, or sell the home. A pending complete loan-modification application may also limit the sale under the Homeowner Bill of Rights.

Is there free foreclosure help in LA County?

Yes. HUD-approved counselors such as Los Angeles Neighborhood Housing Services and East LA Community Corporation offer foreclosure counseling, and the county Department of Consumer and Business Affairs offers free help at 800-593-8222 for owners of properties with 15 or fewer units.

What happens to extra money if my LA home sells at auction?

If the sale price is more than what's owed, the trustee holds the surplus for the former owner and junior lienholders. You can file a claim yourself. Paying a finder or recovery company is not required.

When You Choose Our Services, It Matters More Than You May Know

There was a time when my family and I faced eviction.

We did not have the resources, information, or understanding we needed at the time. We were confused, anxious, and worried about how I was going to take care of my family. I felt powerless standing against a landlord and their attorney because I simply did not know what I needed to know.

That experience stayed with me.

Later in life, I was blessed with the opportunity to come full circle—to learn, research, understand, and obtain the information I once desperately needed. What I went through became more than just a difficult chapter in my life. It became a purpose.

Today, when someone comes to us facing an eviction, foreclosure, landlord-tenant dispute, or another serious matter, I don’t look at their paperwork as just another file.

I understand that there is a person and a family behind those papers.

When I hold your paperwork in my hands, I remind myself that you are trusting me with something incredibly important. In a very real sense, I am holding a representation of your life in my hands.

That responsibility matters to me.

Our clients have shared their experiences through Yelp and Google reviews, telling us that our services helped them when they were facing difficult and uncertain circumstances. While every situation is different and no outcome can ever be guaranteed, those words mean a great deal to us because they remind us why we do what we do.

You deserve information.
You deserve to understand your situation.
You deserve to know what options may be available to you.
And you deserve to be treated with dignity and compassion.

When you choose our services, you’re not just choosing someone to look at paperwork.

You’re choosing someone who understands what it feels like to be on the other side of that paperwork.

Because I’ve been there. And that’s why your situation matters to me.
