Santa Barbara County covers two very different housing markets: the high-priced South Coast around Santa Barbara, Goleta and Carpinteria, and the North County around Santa Maria, Orcutt and Lompoc. Either way, if a foreclosure notice has arrived, you may still be able to stop foreclosure in Santa Barbara County or protect your equity. Here's how the process works locally.

Eviction Defender is not a law firm. We provide guidance and document preparation, handled remotely, so North County and South Coast homeowners get the same help. Our foreclosure help hub covers the statewide rules.

Where Santa Barbara County Notices Are Recorded

Foreclosure notices are recorded by the Santa Barbara County Clerk-Recorder-Assessor. The main Hall of Records is at 1100 Anacapa Street in Santa Barbara, and North County residents can use the Santa Maria office at 511 E. Lakeside Parkway. That's helpful if you want a copy of what's been recorded on your home without driving over the pass.

The first recorded step is usually the Notice of Default. Under federal rules, a servicer generally can't make the first foreclosure filing until the loan is more than 120 days delinquent.

The Notice of Trustee Sale and the Auction

The trustee can record a Notice of Trustee Sale once at least three months have passed since the NOD, and it must be given at least 20 days before the sale. Sales for Santa Barbara County properties are held at the location named in the notice, which the trustee picks. Use the address and time in your own notice, and call the trustee to confirm, because sales are often postponed.

Seasonal and farm income

Many Santa Maria Valley families depend on agricultural work with uneven months. If your hardship is seasonal, explain the pattern to your servicer and ask about forbearance or a repayment plan that fits it.

How to Stop Foreclosure in Santa Barbara County, Step by Step

After the Notice of Default

Submit a complete application for a loan modification or other help. California's Homeowner Bill of Rights generally keeps a servicer from moving forward with a sale while a complete application is pending, with conditions. You can also reinstate by paying what's past due plus fees.

With a sale date set

Reinstatement is open until five business days before the sale, and paying off the loan works up to the sale itself. In South Coast neighborhoods especially, a home may be worth far more than the loan, so selling before the auction can preserve a large amount of equity. See our guide to stopping a trustee sale.

After the sale

No right of redemption exists after a nonjudicial trustee sale. What remains: you may negotiate cash for keys with the buyer, and you should ask the trustee about surplus funds, which are held for the former owner and junior lienholders when a sale brings in more than the debts. Our surplus funds guide explains the claim. You don't need a paid finder. If an eviction case follows, visit our Santa Barbara and Santa Maria eviction help page.

When You Choose Our Services, It Matters More Than You May Know

There was a time when my family and I faced eviction.

We did not have the resources, information, or understanding we needed at the time. We were confused, anxious, and worried about how I was going to take care of my family. I felt powerless standing against a landlord and their attorney because I simply did not know what I needed to know.

That experience stayed with me.

Later in life, I was blessed with the opportunity to come full circle—to learn, research, understand, and obtain the information I once desperately needed. What I went through became more than just a difficult chapter in my life. It became a purpose.

Today, when someone comes to us facing an eviction, foreclosure, landlord-tenant dispute, or another serious matter, I don’t look at their paperwork as just another file.

I understand that there is a person and a family behind those papers.

When I hold your paperwork in my hands, I remind myself that you are trusting me with something incredibly important. In a very real sense, I am holding a representation of your life in my hands.

That responsibility matters to me.

Our clients have shared their experiences through Yelp and Google reviews, telling us that our services helped them when they were facing difficult and uncertain circumstances. While every situation is different and no outcome can ever be guaranteed, those words mean a great deal to us because they remind us why we do what we do.

You deserve information.
You deserve to understand your situation.
You deserve to know what options may be available to you.
And you deserve to be treated with dignity and compassion.

When you choose our services, you’re not just choosing someone to look at paperwork.

You’re choosing someone who understands what it feels like to be on the other side of that paperwork.

Because I’ve been there. And that’s why your situation matters to me.
